The Cigar Association of America (CAA) has taken a decisive step in the ongoing legal battle over premium cigar regulation, submitting a pivotal brief to the U.S. District Court for the District of Columbia. This move comes in direct response to the Circuit Court of Appeals’ January 24, 2025 mandate to establish a clear, market-aligned definition of “premium cigars” – a classification that could shape the industry’s future.

The Legal Crossroads

The brief reinforces Judge Amit Mehta’s groundbreaking 2024 ruling, which deemed the FDA’s regulatory approach “unlawful” and “arbitrary.” While the Circuit Court upheld Mehta’s decision, it remanded the case solely to address the definitional void left by the FDA’s flawed framework.

“This is the industry’s chance to put science and tradition on the record,” declared CAA President Scott Pearce. “For years, the FDA relied on a definition that ignored both marketplace reality and peer-reviewed research.”
